2. Validity

These terms of use apply to users when using the TennisTravellerplatform in their current version.

3. Provision

1. webtelligent makes every effort to ensure the proper operation of the TennisTravellerplatform and the associated services, but does not guarantee the uninterrupted usability or accessibility of the services and therefore assumes no warranty or liability, in particular for delays, interruptions or failures caused by technical reasons.

2. webtelligent reserves the right to make changes, additions or deletions to the information provided without prior notice, as well as to block, modify, delete or temporarily or permanently discontinue the website and the associated offers in whole or in part.

3. Any attempt to disrupt the correct functioning of the TennisTravellerplatform is prohibited.

4. Own content

Webtelligent is responsible for its own content made available through its services in accordance with general law. The limitations of liability set forth in section 6 apply.

5. Third-party content

1. Much of the content available on the TennisTravellerplatform and the services offered through it originates from users of the TennisTravellerplatform. This applies in particular to

• Hotel and campsite reviews
• Hotel and camp photos
• Travel videos
• Image captions
• Content from tennis tourism service providers (hoteliers, camp organizers, tennis tour operators, etc.)

Content published by users is referred to below as "user content".

2. Please note that the publication of user-generated content on TennisTraveller does not constitute an endorsement, statement, evaluation, or recommendation by webtelligent. webtelligent does not adopt the user-generated content as its own. webtelligent does not guarantee that the user-generated content is lawful, accurate, up-to-date, and/or complete.

3. webtelligent is neither obligated nor able to comprehensively examine, monitor and/or investigate the legality of user content or to investigate circumstances that indicate illegal activity.

4. Should webtelligent be notified of legal violations or infringements, webtelligent will immediately conduct appropriate investigations and, if necessary, take further action. In such cases, webtelligent may block or permanently remove user content.

6. Warranty / Liability

1. webtelligent assumes no liability for the completeness, timeliness, accuracy, legality, or any other aspect of the quality of the information provided on the TennisTravellerplatform. This also applies to hotel and camp reviews as well as the newsletter. webtelligent offers this information solely as a guide for the user, even though it is compiled to the best of its knowledge and belief. The user must expect that hotel and camp information may change. Therefore, it is the user's responsibility to verify the accuracy, completeness, and timeliness of the information with appropriate authorities.

2. Furthermore, webtelligent does not guarantee that the content displayed on the TennisTravellerplatform is free of viruses and/or other code/data arrangements that could have a destructive or detrimental effect. Users are responsible for protecting their own devices.

3. webtelligent shall only be liable for damages arising from contractual or non-contractual claims if such damages are caused by intentional or grossly negligent conduct, or by damages resulting from slightly negligent breaches of obligations that are essential for the proper performance of a contract with the user in question and on whose fulfillment the contractual partner may therefore rely (cardinal obligations). In the latter case, liability is limited to the foreseeable, typical contractual damages at the time of conclusion of the contract. The aforementioned limitations of liability shall not apply in cases of injury to life, body, or health, within the scope of the Product Liability Act, or in the case of the assumption of express warranties.

7. Copyright

1. The content/data published on TennisTraveller (e.g., software, products, trademarks such as logos, information, reports, images, illustrations) is legally protected. Reproduction, public display, or any other use or exploitation of this content is generally prohibited without the consent of the respective rights holder. Unless exceptions are provided by law, only personal, non-commercial use within the scope of the intended purpose of the service is permitted.

8. Data protection

1. Webtelligent takes data protection very seriously. Any personal data that the user provides TennisTraveller privacy policy .

3. The extraction, storage or transfer of personal data of other users for purposes other than the intended use is prohibited. 

Terms of use for posting hotel and camp reviews (= user content)

1. Publication opportunity

1. Webtelligent grants the user (revocable at any time) the opportunity to publish certain content (see point 5) on TennisTraveller so that other users can access it. This opportunity is generally provided free of charge; exceptions require a separate agreement.

2. The requirements for the publication of such content, in particular the provision and confirmation of an email address assigned to the user, arise from the respective functionality of the TennisTravellerplatform and can be designed and changed by webtelligent at any time at its own discretion.

3. The minimum age for posting user content is 14 years.

2. User's obligations

1. The user agrees not to post any content that:

• are untrue
• insult, threaten, coerce, defame, glorify violence,
• are pornographic, harmful to minors, racist, inciting hatred or otherwise criminal/illegal in nature,
• Violating the rights of third parties, e.g. copyright, trademark, patent, brand or performance rights, personality rights, data protection rights or property rights.

2. No user may send data or store it on a webtelligent data carrier when using the TennisTravellerportal that, by its nature, size, or number, is likely to impair the functioning of webtelligent's or third parties' computer systems or to infringe their rights (e.g., viruses, Trojans, spam emails, etc.).

3. Users are not permitted to send advertising to other users or third parties via the TennisTravellerplatform. This also applies to posting links. Positive presentations of tennis-specific hotel and camp offers are not considered advertising in this sense, provided the specific requirements for reviews (see below (4)) are met.

4. With regard to hotel and camp reviews (including evaluative statements in comments, image captions, images or videos), the user undertakes in particular to

• to pay attention to the accurate and correct allocation of his rating to a hotel, camp or other service,
• to submit a rating only if he himself has used the service being rated,
• not to submit a review or upload a picture/video if he is the owner or employee of the hotel or camp organizer being reviewed,
• not to make false statements of fact about hotels/camps, persons present there, events or other circumstances/events there,
• not to make value judgments that primarily focus on personal defamation or that primarily serve a purpose other than to give other tennis travelers an authentic impression of a hotel/camp or other service and related circumstances,
• The texts posted do not infringe on the personal rights of other persons through identifying portrayals.

5. If a user violates these terms of use, webtelligent is entitled to delete or block content without notifying the user and without giving reasons. The same applies if there is sufficient suspicion of such violations. All other rights and claims remain unaffected.

3. Granting of rights

1. The user grants webtelligent the right, free of charge and on a non-exclusive basis, to store, reproduce, and publish all user-generated content on the TennisTravellerplatform or in other media for which it is responsible, such as social media platforms or in the newsletter.

2. The user warrants that they are the holder of the necessary rights, in particular the copyrights, to the user content in order to grant webtelligent the rights pursuant to paragraph (1). It is the user's sole responsibility to acquire the necessary rights to upload the user content to webtelligent's service. As a rule, a user only possesses the necessary rights if they created the content in question themselves.

3. The granting of rights pursuant to paragraph 1 shall be valid indefinitely, unless the user of webtelligent proves circumstances which would make further access to the content unreasonable for the future (e.g. due to serious disadvantages).

4. Exemption clause

The user agrees to indemnify webtelligent against all third-party claims, including reasonable or legally stipulated costs of legal defense, arising from a culpable breach of the user's obligations under Section 2 or the warranty under Section 3(2). The user shall support webtelligent in defending against such claims, in particular by providing all information necessary for the defense.
